2. Legal Framework and Responsibility
Go Africa Tours LTD operates as a tour organiser under the Package Travel and Linked Travel Arrangements Regulations 2018. We accept responsibility for the proper performance of all travel services included in your package, whether performed by us directly or by our approved local partners.
We operate a hybrid business model:
- Accommodations are contracted and booked directly by Go Africa Tours LTD.
- Ground operations, transport, and guided activities are provided by local partner operators under our supervision.
We remain contractually responsible for the overall execution and quality of the package.

3. Availability
All quoted hotels, lodges, and accommodations are subject to availability at the time of booking. While we make every effort to secure the advertised properties, we cannot guarantee availability until full payment and confirmation are received.
Before finalising your booking, Go Africa Tours LTD will reconfirm availability. If your preferred accommodation or service becomes unavailable, we will offer a comparable alternative of similar standard and value.

4. Booking, Contract Formation, and Payment
- 4.1. Contract Formation:
A binding contract is formed once:
- You confirm your intent to proceed,
- We issue a Booking Confirmation, and
- You make full payment
By confirming your booking, you agree that you have had the opportunity to review these Terms (available at www.goafricatour.com/terms), and that the contract is governed by them.
- 4.2. Payment Terms:
- Full payment is required at the time of booking to confirm your reservation.
- Payment can be made via credit or debit card or bank transfer.
- All prices will be displayed in the customer’s local currency (GBP, USD, or EUR) at the time of booking.
- 4.3. Price Adjustments:
Prices are based on prevailing exchange rates, local taxes, and service costs at the time of quotation. Go Africa Tours LTD reserves the right to adjust prices prior to confirmation in the event of material changes in supplier costs, currency rates, or government taxes.

5. Cancellation, Refunds & Amendments
- 5.1. Flights:
All flights are non-refundable, regardless of cancellation timing.
- 5.2. Safari Packages and Tours:
- 50% Refund – Cancellations made 90 days or more prior to departure.
- No Refund – Cancellations made less than 90 days prior to departure.
Refunds, where applicable, will be processed within 10 business days after receipt of your written cancellation request and confirmation of eligibility.
- 5.3. Amendments:
Go Africa Tours LTD treats all amendments — including changes to travel dates, traveller names, itineraries, or accommodations — as cancellations of the original booking. The cancellation policy outlined in Section 5.2 applies.
To make changes, you must cancel the existing booking under the applicable terms and proceed with a new booking at current rates and availability.

6. Changes or Cancellations by Go Africa Tours LTD
- 6.1. Minor Changes:
If necessary, we may occasionally make minor changes to your itinerary (such as substitution of hotels for others of similar standard, or small timing adjustments). You will be notified as soon as possible, and no compensation will be due for such changes.
- 6.2. Major Changes:
If a significant change occurs (e.g. major itinerary alteration, or downgrade of accommodation standard), you may:
- Accept the revised arrangements.
- Cancel and receive a full refund of all monies paid.
- 6.3. Force Majeure:
Go Africa Tours LTD shall not be held liable for failure, delay, or alteration caused by circumstances beyond reasonable control (“Force Majeure”), including:
- Natural disasters or adverse weather
- War, terrorism, or civil unrest
- Government actions, strikes, or travel restrictions
- Epidemics or pandemics
We will attempt to offer alternatives, but no refunds or compensation are payable for Force Majeure events.

7. Financial Protection and Consumer Notice
Clients are advised to purchase comprehensive travel insurance, including financial protection. We are working to secure formal financial protection and will provide updates on our website.

8. Travel Insurance
Comprehensive travel insurance is strongly recommended for all travellers. Coverage should include:
- Medical expenses and emergency evacuation
- Trip cancellation or curtailment
- Loss, theft, or damage to luggage
- Personal liability
Go Africa Tours LTD accepts no responsibility for losses arising from inadequate insurance.

9. Health, Safety, and Special Requirements
You must ensure you are fit to travel and disclose at booking:
- Medical conditions or allergies
- Disabilities or special needs
- Dietary requirements
Failure to disclose may result in cancellation without refund. You are responsible for passports, visas, and vaccinations. We are not liable for losses from failure to comply with entry or health requirements.

10. Our Liability
Go Africa Tours LTD accepts responsibility for proper performance under the Package Travel Regulations 2018.
We are not liable for:- Personal injury, illness, or death except where caused by our negligence
- Loss or damage arising from your own actions
- Loss, theft, or damage to personal property, including luggage and valuables, unless caused by our proven negligence
- Any inconvenience, delay, or additional expense caused by weather conditions, including seasonal rainfall, flooding, or mud affecting transport, roads, or itinerary, including vehicles getting stuck
Total liability shall not exceed the total booking price.

11. Complaints & Dispute Resolution
Report problems during travel immediately to your local guide or hello@goafricatour.com.
Written complaints must be submitted within 28 days of return. Go Africa Tours LTD will respond within 21 business days. Unresolved disputes may be referred to ADR, which we will consider in good faith.

12. Data Protection and Privacy
We comply with the UK Data Protection Act 2018 and UK GDPR. Your personal data is used solely to manage travel arrangements and will not be shared except as needed for bookings. See our Privacy Policy for details.

13. Governing Law and Jurisdiction – International Bookings
These Terms and any disputes shall be governed by the laws of England and Wales, except where mandatory consumer protection laws in your country of residence require otherwise. The courts of England and Wales shall have exclusive jurisdiction, unless local law provides non-waivable rights.
For EU and US clients, certain statutory consumer rights may apply that cannot be waived. These Terms do not affect your mandatory rights under local consumer protection law.

14. Consumer Rights
These Terms do not affect your statutory rights under the Consumer Rights Act 2015, Package Travel Regulations 2018, or other applicable law in your country of residence.

15. Entire Agreement
These Terms, together with your booking confirmation, constitute the entire agreement between you and Go Africa Tours LTD.
15.1. Booking Confirmation Terms Override:In the event of any conflict or inconsistency between these Terms and the specific terms outlined in your Booking Confirmation, the Booking Confirmation shall take precedence. These Terms apply to all aspects of your booking not specifically addressed in the Booking Confirmation.
