Terms of Service - For Customers
  1. Introduction

    These Terms of Service are a binding legal agreement between you and Go Africa Tours LTD, (“Go Africa”, “we” or “us”), a UK Registered company, that govern your use of the websites, applications.

    The Term begins as soon as you access the Website and continues as long as you use the Service. Clicking the button and entering your username means that you have officially “signed” the Terms.

  2. Modification of these Terms

    Go Africa Tours LTD may modify these Terms at any time and with immediate effect. If we make amendments, they apply as of the date of their publication on the Website. Go Africa Tours LTD expects you to regularly refer to this section to make sure you are familiar with the applicable Terms of Use. Your continued access to or use of the Go Africa Tours LTD Platform will constitute acceptance of the revised Terms.

  3. Go Africa Tours LTD’s Role
    1. 3.1. Marketing Platform:

      Go Africa Tours LTD is an online platform that enables Tour organisers to publish their tours and services. Go Africa does not perform or supply any Services; actual performance of Services is undertaken by the vendor. When you purchase any service through Go Africa, you enter into an agreement with the vendor and Go Africa acts solely as an intermediary which connects two parties. Go Africa Tours LTD is not a party to the contracts concluded directly between Vendors and Customers, nor is Go Africa Tours LTD an organiser or retailer of travel packages. Go Africa Tours LTD is not acting as an agent in any capacity.

    2. 3.2.Payments collection: Go Africa Tours LTD, acts as a payment collection agent. We collect payment from customers and release it to Tour Organisers.
    3. 3.3.Vetting of Tour Organisers:

      In order to ensure that we are onboarding professional and reliable Tour organisers, we make our best efforts to screen Tour Organisers by collecting their details and documentation (Name & Surname, Phone number, email, address, ID card, Trade Licence or Tour Guide Licence, Bank details) when they sign up to the platform; however, we cannot guarantee the accuracy of information & documentation provided by the Tour Organisers or control their conduct or performance. Furthermore, we do not guarantee the accuracy of any Listing descriptions, or other Content provided by Tour Organisers. You acknowledge that Go Africa Tours LTD has no general obligation to monitor to verify the information and the content provided by Tour Organisers but has the right to remove Tour Organisers from the platform in case of misconduct (including and not limited to Fraud, misrepresentation)

  4. Customer’s Account

    In order to use Go Africa, you must 1) be at least eighteen (18) years old and able to enter into contracts; 2) complete the registration process; 3) agree to the Terms including our Privacy Policy; and 4) provide true, complete, and up to date legal and contact information. If you sign up for Go Africa on behalf of a company or other entity, you represent and warrant that you have the authority to accept these Terms on their behalf. You may not register more than one account or transfer your account to someone else. You are responsible for keeping your account credentials confidential and may not disclose your credentials to any third party. You are responsible and liable for activities conducted through your Go Africa Tours LTD Account. You will immediately notify us of any unauthorized use of your accounts.

  5. Booking

    Customers must check the description of the services and products carefully before making a booking. customers agree to be bound by all the conditions as contained in booking confirmation.

    When you book a Listing, you are agreeing to pay all charges for your booking identified during checkout (“Total Price”).

    When you receive the booking confirmation, a contract is formed directly between you and the Tour Organiser. The cancellation policy and any other rules, standards, policies, or requirements identified in the Listing or during checkout form part of your contract with the Tour Organiser.

    You are responsible for confirming that you, and your party, meet minimum age, fitness, or other requirements. You are responsible for informing the organiser of any medical or physical conditions, or other circumstances that may impact your ability to participate, attend or use the service.

    If a customer intends to make a booking on behalf of another person, it shall be the responsibility of the Member to inform such person about the terms of this Agreement, including all rules and restrictions applicable thereto.

    If you are booking for an additional customer who is a minor or if you bring a minor to a Service, you must be legally authorized to act on behalf of the minor and you are solely responsible for the supervision of that minor.

  6. Travel Documentation and Insurance:

    Travel documentation and Insurance are to be obtained by the customer as per the requirements of the countries in Africa, the Member intends to visit or transit through. Go Africa Tours LTD is not responsible for any issues, including inability to travel, related to Travel Documentation and Insurance, and is also not liable to refund any amount to the Member. for being unable to utilize the booking due to absence or denial any documents. Refund, if any, will be as per the applicable terms of booking and cancellation policy.

  7. Prices and Payments

    All prices on Go Africa Tours LTD are quoted per person and include VAT and all taxes.

    When using the website, you will be able to convert the prices to the available currencies. At the moment of payment, the price of the price will be converted in real-time to the selected currency. This amount may slightly differ from the listed price, due to real-time conversion and currency exchange.

    The Customer shall not share their personal sensitive information like credit/debit card number, CVV, OTP, card expiry date, user IDs, passwords etc. with any person including the Tour Organiser, employees, or representatives of Go Africa.

    Refunds, Cancellations and No-shows

  8. Cancellations, Booking Modifications

    Booking(s) made by the Members through the Website are subject to the applicable cancellation policy as set out on the booking page. Refunds, if any, on cancelled or modified bookings will always be processed to the respective account or the banking instrument (credit card, wallet etc.) from which payment was made for that booking. If you cancel or modify a booking, the amount refunded to you is determined by the cancellation policy that applies to that booking. If the Tour organiser cancels, or you experience a Travel Issue, you may be entitled to rebooking assistance or a partial or full refund

    If cancellation policy is not mentioned on the booking page, following cancellation policy will apply:

    If the duration of the tour is zero to 1 Day More than 07 days prior to start date: Full Refund except payment processing fees
    Between 2-7 days prior to start date: 50% refund except payment processing fees
    Less than 2 days prior to start date: No Refund
    If the duration of the tour between 1-3 Days More than 21 days prior to start date: Full Refund except payment processing fees
    Between 14-21 days prior to start date: 50% refund except payment processing fees
    Less than 14 days prior to start date: No Refund
    If the duration of the tour is more than 3 Days More than 28 days prior to start date: Full Refund except payment processing fees
    Between 21-18 days prior to start date: 50% refund except payment processing fees
    Less than 21 days prior to start date: No Refund

    In the rare circumstance of a booking not getting fulfilled for any reason whatsoever, we will process the refund of the booking amount paid by the customer. We will do our best to assist you, however, we are not under any obligation to provide an alternate booking in lieu of or to replace the unfulfilled booking.

  9. Contact & communication with Tour Organisers

    The Tour Organiser and the customer shall interact directly with each other through Go Africa’s systems. Go Africa Tours LTD has no control or responsibility over any correspondence between Tour Organizers and vendors occurred out of our systems. Once the booking is confirmed and customer has paid, the parties (customer & tour Organiser) are free to choose to move the conversation with the customer out of Go Africa’s systems. If any issue arises, Go Africa will only provide support for the correspondence that accoutred within the Go Africa system.

  10. Intellectual Property Rights
    1. 10.1. The Services and Website contains Intellectual Property of Go Africa in the form of website content, graphics, videos, audios, text, and any other digital content (“Website Content”). This is an Agreement for the Services, and you are not granted a license to any Website Content under this Agreement. Except to the extent that applicable laws prevent Go Africa from doing so, you will not, directly or indirectly: (i) reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, object code, or underlying structure, ideas, or algorithms of, or found at or through the Services or the Website, or Website Content; (ii) remove any proprietary notices or labels from the Website Content; reproduce or copy the Website Content or any part thereof; (iii) modify, translate, or create derivative works based on the Website Content; (iv) copy, distribute, pledge, assign, or otherwise transfer or encumber rights to the Website Content; (v) create any derivative product from any of the foregoing; (vi) without our express written permission, introduce automated agents or scripts to the Services so as to produce multiple accounts, generate automated searches, requests and queries, or to strip or mine data from the Services; or (vii) allow third parties to gain access to the Services or to Website Content in any manner other than as expressly permitted in this Agreement.

    2. 10.2. The Services shall be used for your own personal use and you shall not use the Services or any Website Content for your commercial benefit or commercial benefit of any third party.

    3. 10.3. You acknowledge and agree that the Services, the Company names and logos and all related product and service names, design marks and slogans, and all other material comprising the Services, are the property of the Go Africa or its affiliates or suppliers (collectively, the “Marks”). Unless stated otherwise, all Marks are protected as the copyright, trade dress, trademarks and/ or other intellectual properties are owned by Go Africa or by other parties that have licensed their material to Go Africa. You are not authorized to use any of the Marks in any advertising, publicity, or any other commercial manner without the prior written consent of Go Africa. Your use of the Services confers no title or ownership in the Services or the Marks and is not a sale of any rights in the Services or the Marks. All ownership rights remain in Go Africa or its third-party suppliers, as the case may be.

    4. 10.4. 4You retain ownership of the materials you upload to the Service. We may use or disclose your materials only as we describe in these Terms and our Privacy Policy.

  11. Privacy Policy
    1. 11.1. In using the varied features of the Services, you may provide information (such as name, contact information, or other registration information) to Go Africa. Go Africa may use this information and any technical information about your use of the Services to tailor its presentations to you, facilitate your movement through the Services, or to communicate separately with you.
    2. 11.2. We may use and disclose your information according to our Privacy Policy. Our Privacy Policy will be treated as part of these Terms.
  12. Limitation of Liability
    1. 12.1. To the maximum extent permitted by law, you assume full responsibility for any loss that results from your use of the Website and the Services, including any downloads from the Website. We shall not be liable for any indirect, punitive, special, or consequential damages under any circumstances, even if they are based on negligence or we have been advised of the possibility of those damages. Our total liability for all claims made about the Service will be no more than what you paid us for the Service.

  13. No Warranties
    1. 13.1. To the maximum extent permitted by law, we provide the material on the Website and the Service as is. That means we do not provide warranties of any kind, either express or implied, including but not limited to warranties of merchantability and fitness for a particular purpose.

    2. 13.2. From time to time down-time, either scheduled or unscheduled, may occur. Go Africa will work within reason to ensure this amount of down-time is limited. Go Africa will not be held liable for the consequences of any down-time.

    3. 13.3. Go Africa cannot guarantee that Website Content or Content available for download and/or execution from or via the Services is free from viruses or other conditions which could damage or interfere with data, hardware, or software with which it might be used. You assume all risk of use of all files associated with the Services, and you release Go Africa entirely of all responsibility for any consequences of its use.

  14. Indemnity

    You agree to indemnify and hold us harmless from any losses (including attorney fees) that result from any claims you make that are not allowed under these Terms due to a “Limitation of Liability” or other provision. You also agree to indemnify and hold us harmless from any losses (including attorney fees) that result from third-party claims that you or someone using your password did something that, if true, would violate any of these Terms.

  15. Third-Party Vendors

    When you make any booking or purchase any service on the Website, you enter into an agreement with the third-party vendors and therefore any claim for damages or claim against deficiency of services lies against the third-party vendors and no claim shall lie against Go Africa. Third-party vendors agree to address and settle all the claims which Members may have with respect to the booking(s) or purchases made on the Website

  16. Assignments

    You may not assign any of your rights under this agreement to anyone else. We may assign our rights to any other individual or entity at our discretion.

  17. Choice of Law

    Laws of the United Kingdom will apply to any dispute related to these Terms or the Service. Any dispute related to the Terms, the Privacy Policy, or the Service itself will be decided by the appropriate judicial courts located in London and each party will be subject to the jurisdiction of those courts.

  18. Force Majeure

    We will not be held liable for any delays or failure in performance of any part of the Service, from any cause beyond our control. This includes, but is not limited to, acts of God, changes to law or regulations, embargoes, war, terrorist acts, riots, fires, earthquakes, floods, strikes, power blackouts, volcanic action, unusually severe weather conditions, and acts of hackers or third-party internet service providers.

  19. Survivability

    Even if this Agreement is terminated, the following sections will continue to apply: Limitation of Liability, No Warranties, Indemnity, Choice of Law, Severability, and Entire Agreement.

  20. Severability

    If it turns out that a section of this Agreement is not enforceable, then that section will be removed or edited as little as necessary, and the rest of the Terms will still be valid.

  21. Interpretation

    The headers are provided only to make this agreement easier to read and understand.

  22. Amendments and Waiver

    Amendments or changes to these Terms will not be effective until we post revised Terms on the Website. That aside, additional terms may apply to certain features of the Service. The Additional Terms will be considered incorporated into these Terms when you activate the feature. Where there is a conflict between these Terms and the Additional Terms, the Additional Terms will control.

  23. Entire Agreement

    These Terms, our Privacy Policy, and any Additional Terms you have agreed to make up the entire agreement and supersede all prior agreements, representations, and understandings.
